JUST STEEL – TERMS AND CONDITIONS

By accepting a quotation, paying a deposit, or making use of our services, the customer agrees to these Terms and Conditions.

Just Steel designs, manufactures, supplies, installs, repairs, and maintains steel, aluminium, and related fabricated products including but not limited to:

• Gates

• Balustrades

• Burglar bars

• Carports

• Pergolas

• Staircases

• Structural steelwork

• Jungle gyms

• Fencing

• General steel and aluminium fabrication

All work is custom-made unless otherwise specified.

2.1 All quotations are valid for 30 days unless otherwise stated.

2.2 Prices may change due to:

• Material price increases

• Fuel increases

• Changes in scope of work

• Site complications

• Delays caused by the client

2.3 Quotations are based on the information provided at the time of inspection or inquiry.

2.4 Any additional work requested after approval of quotation will be charged separately.

3.1 A 70% deposit is required before any manufacturing or material ordering begins.

3.2 Standard payment terms:

• 70% Deposit

• 20% Material payment

• 10% Upon completion unless otherwise agreed in writing.

3.3 Ownership of goods remains with Just Steel until full payment has been received.

3.4 Late payments may result in:

• Delayed installation

• Suspension of work

• Storage fees

• Legal recovery costs

4.1 Most products manufactured by Just Steel are custom-made to customer specifications.

4.2 Once manufacturing has started, cancellations may result in forfeiture of deposits to cover:

• Materials purchased

• Labour costs

• Design work

• Manufacturing time

4.3 Slight variations in:

• Colour

• Finish

• Weld appearance

• Material texture

• Measurements may occur and do not qualify as defects.

5.1 The customer must ensure the site is accessible and ready for installation.

5.2 Delays caused by:

• Builders

• Electricians

• Weather

• Site readiness

• Power outages

• Other contractors may affect installation timelines.

5.3 Installation dates are estimated and not guaranteed.

5.4 Additional site visits caused by customer delays may be charged separately.

6.1 Steel products may naturally experience:

• Surface rust

• Expansion/contraction

• Weathering over time depending on environmental conditions.

6.2 Coastal areas and high-moisture environments may accelerate corrosion.

6.3 Proper maintenance is required by the customer, including:

• Cleaning

• Rust treatment

• Lubrication

• Repainting where necessary

6.4 Powder coating, galvanising, and paint finishes are durable but not indestructible.

Damage caused by:

• Chemicals

• Neglect

• Impact

• Abuse

• Weather disasters is not covered under warranty.

7. JUNGLE GYMS & PLAY EQUIPMENT

7.1 Adult supervision is required at all times when children use jungle gyms.

7.2 Products must be used according to intended age and weight limits.

7.2.1 Jungle gyms must only be used by children within the recommended age group specified for that particular product. Just Steel manufactures and supplies jungle gyms for various age categories, including but not limited to:

• 12 months – 3 years

• 18 months – 3 years

• 3 years – 10 years

• Other age groups as specified at the time of sale, rental, or installation.

7.2.2 It is the customer’s responsibility to ensure that children using the jungle gym fall within the recommended age group and use the equipment appropriately.

7.2.3 Any damage, breakage, excessive wear, loss, or safety issues resulting from use outside the recommended age group, misuse, overloading, negligence, or failure to follow the intended usage guidelines shall be the responsibility of the customer. The customer agrees to pay for all repairs, replacement parts, replacement equipment, transport costs, call-out fees, and labour costs required to restore, repair, replace, or make safe the equipment as a result of such damage.

7.3 Customers are responsible for:

• Safe installation area

• Soft landing surfaces

• Ongoing maintenance checks

7.4 Just Steel is not liable for injuries caused by:

• Misuse

• Lack of supervision

• Improper use

• Alterations made after installation

7.5 Ropes, swings, bolts, and outdoor components may wear over time and require maintenance.

8. WARRANTY

8.1 Workmanship warranty applies only to manufacturing or installation defects.

8.2 Warranty does not cover:

• Rust caused by neglect

• Wear and tear

• Misuse

• Customer damage

• Third-party modifications

• Electrical surges on automation systems

• Storm, flood, or fire damage

8.3 Automation equipment carries supplier/manufacturer warranties where applicable.

8.4 Warranty claims must be reported in writing with photos.

9. RETURNS & REFUNDS

Custom-made products cannot be returned or refunded once manufacturing has started unless:

• The item is materially defective

• The item differs substantially from approved specifications

Unused standard products may qualify for return within 7 days subject to:

• Approval

• Inspection

• Restocking fees

• Transport costs

Products must:

• Be unused

• Be in original condition

• Not be damaged

10. CUSTOMER COMPLAINT PROCEDURE

Step 1:

The customer must notify Just Steel in writing within 7 days of installation or delivery.

Step 2:

Photos and a description of the issue must be provided.

Step 3:

An inspection will be arranged where necessary.

Step 4:

If the issue is found to be workmanship-related, Just Steel will:

• Repair

• Adjust

• Replace affected sections within a reasonable time.

The customer may not appoint third-party contractors to repair the work without written approval from Just Steel.

11. JUNGLE GYM RETURN OR SAFETY ISSUE PROCEDURE

If there is an issue with a jungle gym:

• Customer must immediately stop using the product if safety is affected.

• Photos/videos of the issue must be sent.

• Just Steel may inspect the installation site.

• If the issue relates to manufacturing or installation, repairs or replacements may be arranged.

• Damage caused by misuse, overloading, weather, or poor maintenance is not covered.

Due to hygiene and safety reasons, used jungle gyms generally cannot be returned unless there is a manufacturing defect.

12. GATES, BALUSTRADES & STRUCTURAL WORK COMPLAINTS

Customers must report:

• Alignment issues

• Welding concerns

• Paint defects

• Operational issues within 7 days after installation.

Minor adjustments, settling, or alignment corrections may form part of standard post-installation snagging.

13. LIMITATION OF LIABILITY

Just Steel shall not be liable for:

• Indirect losses

• Consequential damages

• Delays beyond reasonable control

• Loss caused by misuse or negligence

• Injuries resulting from improper use of products

Maximum liability shall not exceed the amount paid by the customer for the specific product or service.

14. GOVERNING LAW

These Terms and Conditions are governed by the laws of South Africa.

Any disputes shall first attempt to be resolved amicably before legal action is taken.

15. ACCEPTANCE

Acceptance of a quotation, payment of a deposit, or use of services constitutes acceptance of these Terms and Conditions.
